IS POT LEGAL?
With 24 States legalizing marijuana in one form or another, several clients have asked me “what’s the deal in Florida?” The short answer is, Pot Is Still Illegal in Florida. Yes, there is Charlotte’s Web. Charlotte’s Web takes its name from a strain of marijuana low in THC, the chemical that produces a high. Low-THC strains –thought to provide relief to children who suffer from epilepsy and other conditions that cause seizures — are the only ones allowed under the law. So unless you qualify under Charlotte’s Web, you will still get in trouble if you are found with any amount of pot.
Possession of marijuana can either be a misdemeanor or a felony depending on the amount possessed. If you possess 20 grams or more it can be punished as a 3rd-degree felony punishable by up to 5 years in prison. If you possess less than 20 grams it is punishable as a first-degree misdemeanor punishable by up to one year in the county jail. Even worse, if you are adjudicated of even a misdemeanor, you can lose your driver’s license for a year.
So, if you are living or visiting Florida, make sure you don’t drive with Any amount of pot in your card. Since I have been asked, more than once, where can I go to smoke pot legally, I have provided a list below of the States which have legalized it for recreational use and/or medical use.

Those in the know believe that up to 11 States will be legalizing cannabis in one form or another in the next year. Florida in will have a Medical Marijuana Amendment on the November ballot. So if you care about this issue, one way or the other, make sure you vote in November.
